Please read the following terms and conditions carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that apply to your purchases.
Any reference to “we”; “us” and “our” in these Terms and Conditions is deemed to refer to Outdoors 365 Equipment (the “Company” or “Outdoors 365”).
Any reference to “you” and “your” is deemed to refer to a user (the “Customer”) of the website www.outdoors365.co.za, related mobile sites and applications (the “Website”) or purchaser of the products displayed on the Website (the “Goods”).
Once the box labelled “I accept” has been ticked by you, a legally binding contract comes into existence between you and the Company.
These Terms and Conditions govern your use of the Outdoors 365 Equipment Website located at the domain name www.outdoors365.co.za. By accessing and using the Website, you agree to be bound by the Terms and Conditions set out in this legal notice. You may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the Website for marketing and other purposes without the consent of the Provider.
Transaction Currency is South African Rand (ZAR). Every product is displayed with its price. If on sale, the sale price will display. Prices are subject to change without notice. We will take all reasonable efforts to maintain correct prices on the Website and Tax Invoices. Should errors occur or items be offered at incorrect prices, we will not be obliged to sell goods at such incorrect prices and shall only be liable to refund. Errors and Omission excluded.
Discount Vouchers or Coupons
When we are feeling generous, or want to spread the love, we give Discount Coupons to loyal customers from time to time. If you are one of those lucky fishes you simply input the coupon code during the checkout process where the discount amount will be subtracted from the total amount.
Payment can be made via our Credit Card facility on collection at our Warehouse, or we accept Electronic Funds Transfer (EFT) into our bank account, the details of which will be provided upon checkout.
Please note, when selecting to pay by EFT, you have 48 hours after placing your order and receiving your Tax Invoice to make the payment.
When making your payment, please be sure to use your Invoice number as your reference. This will ensure that we can process your order as quickly as possible.
We will start processing your order as soon as your bank forwards the payment to us. Depending on the bank, it can take up to 2 days from the time you make the payment (which has to be done a maximum of 48 hours after placing the order) to when it appears in our bank account.
The delivery lead time as specified on the Website only starts once Outdoors 365 has received the payment from your bank.
We have several delivery options available to you, depending on how quickly you need your tackle for your next tournament or competition!
– Delivery by courier (up to 2 days)
– Delivery by courier (Same day or overnight)
– SAPO Overnight Bag
– SAPO Ordinary Parcel (3 to 4 days)
– PostNet Overnight
Delivery cost is dependent on the option chosen as well as where delivery is required. A surcharge will be included for deliveries to farms, remote hospitals, power stations and high risk town ships. Delivery charges are subject to change without notice.
We only deliver within business hours, i.e. there are no deliveries over weekends or on public holidays. Please take this into consideration when selecting your delivery address. Courier deliveries cannot be delivered to a PO Box address and must be an address where someone can sign for the parcel during office hours.
As the Customer, you indicate in the checkout process where in South Africa you require delivery, as well as contact numbers to be used in connection with delivery. Outdoors 365 assumes no liability for orders shipped to incomplete or incorrect shipping addresses supplied by you. Any additional fees for such orders will be your responsibility.
If you choose Courier delivery, if nobody is present at the address at the time of delivery, our chosen courier will leave a calling card with their cell phone number on it to indicate that there was an attempted delivery and for you to phone to re-arrange delivery.
If you don’t contact them, the courier will try once more the following day, where after the parcel will be sent back to their depot where they will attempt to contact you using the telephone number provided in the checkout process. Failing that, the parcel will be sent back to us where we will contact you to discuss potential re-delivery at your own cost.
If this attempt does not succeed within a reasonable amount of time, we will reimburse you the Rand value paid for the product(s) purchased. Should a delivery fee have been charged on the order, this will not be reimbursed.
A delivery is considered complete as soon as the parcel is accepted by an individual on your behalf at your specified delivery address. This also applies when the package has been handed over by the courier, as indicated in the courier’s tracking system.
If a package is refused upon delivery, the customer will be responsible for all shipping charges incurred for the return of the item. Charges will be applied to any refund due to refusal. This policy does not apply to any merchandise that is received defective or damaged. Please refer to the Returns and Refund Policy section
Returns and Refund Policy
Accidents happen! If we supply you with the wrong product, or you have a damaged or faulty item, please accept our humble apologies and contact us immediately on [email protected]. We will collect the item at our expense and exchange it for the correct one within 14 days. We will make a reasonable effort to exchange the product, but if replacement is not possible, we will refund the purchase price including delivery cost.
In accordance with the Consumer Protection Act, you are entitled to cancel your order of goods within 7 days after receipt thereof. We are sure you won’t be, but if you are not happy for any reason and would like to return your order for a refund, please follow the steps below:
– Email us on [email protected], explaining the reason for return.
– We will advise you if we approve return of the Goods whereupon you may courier or post the Goods to our warehouse: Outdoors 365 Equipment, 2 Spencer Road, Athlone Park, Umbogintwini, Kwazulu Natal, 4126.
– Items must be returned within 14 days after they have been approved for return and must be received in original condition AND packaging. Refunds will only be considered where the items are in their unused original sealed packaging.
– Items that are returned need to be well packaged or wrapped to ensure there is no damage when returned. Items damaged due to poor packaging and handling will be subject to partial or no refund.
– All items that are returned must be sent to us using a trackable and insured delivery method. Please be sure to retain your returns delivery receipt in case the return gets lost in the post.
– Shipping/courier costs are non-refundable and will be for the Customer’s account.
– Sales items cannot be returned and all sales are final.
– Although seldom charged, Outdoors 365 reserves the right to charge a 10% administration fee for returned orders should the returns process incur significant administration expenses.
– Once received, you will be refunded the purchase price of the items within 30 days less any delivery/courier fee.
PLEASE NOTE: CANCELLATION OF THE SALE AND REFUND CAN ONLY OCCUR WHERE THE ITEMS ARE IN THEIR ORIGINAL SEALED PACKAGING.

Cancelled and paid orders on the Outdoors 365 Website will be refunded after deduction of a charge for administration costs.
We reserve the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet our standards. Should we exercise this right, you will receive a full refund with no deductions.
Our online shop acts as a catalogue of the products supplied by us. These products are sourced from our many exclusive suppliers and it is not possible (although we try very hard!!!) to keep stock of every item at all times. We shall take all reasonable efforts to supply the goods that have been ordered, but sometimes it does happen that between the time the order is placed and payment received an item becomes out of stock. In this case we will inform you as soon as possible of the shortage and will place the item on backorder or replace with another suitable and equally awesome product. We cannot be liable for items which are out of stock from the supplier.
Agreement of Sale
Placing an item in the Tackle Box (shopping cart) without “ticking the box” and completing the purchase does not:
a) constitute an agreement of sale between Outdoors 365 and the Customer. We will not be held liable if such items are not available when the purchase is completed later;
b) constitute an order for such an item; and we may remove such an item from the shopping basket if no stock is available.
An agreement of sale between Outdoors 365 and the Customer only comes into effect if and when:
a) A credit card authorisation is received from the issuing bank; or
b) A deposit of an electronic transfer is reflected on Outdoors 365 bank statement (and only if such payment is received within 48 hours after completion of the purchase).
Outdoors 365 reserves the right to refuse to accept and/or execute an order without giving any reasons.
Outdoors 365 also reserves the right to cancel orders in whole or in part as circumstances dictate. Outdoors 365 shall only be liable to refund monies already paid by the Customer.

By using this Website or communicating with us by electronic means, you consent and acknowledge that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.
The Website www.outdoors365.co.za sells fishing tackle and outdoor accessories and goods online. The use of any product bought from this Website is at the Customer’s risk. The Customer indemnifies and holds Outdoors 365 harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.
Outdoors 365 shall take all reasonable steps to protect the personal information of the Customer. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/html/govdocs/legislation/2000/act2.pdf. The private information required for executing the orders placed through the e-commerce facility, namely the Customer’s personal information, delivery address and telephone numbers will be kept in the strictest confidence by Outdoors 365 and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.
However, due to the nature of the internet, Outdoors 365 cannot guarantee that no unauthorised parties will have access to your information and will not be held liable for any loss or damage that you may sustain as a result of unauthorised access to your personal information. Credit Card details are not kept by Outdoors 365 under any circumstances.
Outdoors 365 undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. Outdoors 365 cannot be held responsible for security breaches occurring on the Customer’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the Customer may inadvertently have installed on his/her device.
Intellectual Property Rights and Limited License
Outdoors 365 grants to the Customer, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.
This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of Outdoors 365. The license does not allow the Customer to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this Website or the Content for the benefit of another merchant. The Customer may not frame nor use framing technologies to enclose the Website or the Content nor any part thereof without the express written consent of Provider.
Outdoors 365 and the Owners do not offer products or services to minors. If you are under the age of 18, you may not respond to or otherwise accept or act upon any offers in the Website.
Outdoors 365 and the Owners, their affiliates or subsidiary reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. Any unauthorised use terminates this license.
Any user who places any information on any platform of the Outdoors 365 Website, grants to Outdoors 365 a perpetual, non-exclusive, royalty-free, irrevocable, unrestricted, worldwide license to use, copy, sub license, redistribute, adapt, transmit, publish and/or broadcast, publicly perform or display the information or material or any part of it.

This Website is supplied on an “as is” basis and has not been compiled or supplied to meet the Customer’s individual requirements. It is the sole responsibility of the Customer to satisfy itself prior to entering into this agreement with Outdoors 365 that the service available from and through this Website will meet the Customer’s individual requirements and be compatible with the Customer’s hardware and/or software.
Information, ideas and opinions expressed on this Website should not be regarded as professional advice or the official opinion of Outdoors 365 and Customers are encouraged to consult professional advice before taking any course of action related to information, ideas or opinions expressed on this site.
All items purchased from Outdoors 365 are made pursuant to agreements with shipping and delivery agents and risk of loss pass from Outdoors 365 to such agents upon delivery of any item to such carrier.

Availability of the Website
Outdoors 365 reserves the right to limit the availability of the Website as and when it is necessary for purposes of maintenance or other reasons.

This Website is hosted, controlled and operated from the Outdoors 365 offices within the Republic of South Africa and therefore governed by South African law. The Customer may not use this Website in violation of South African export laws and regulations. If the Customer accesses this Website from locations outside of South Africa, that Customer is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the Customer consents to the jurisdiction of the Cape Town High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between Outdoors 365 and the Customer with regard to the use of the Content and this Website.
Any person that delivers or attempts to deliver any damaging code to this Website or attempts to gain unauthorised access to any page on this Website shall be prosecuted and civil damages shall be claimed in the event that Outdoors 365 suffers any damage or loss.
The Customer allows Outdoors 365 to take all reasonable steps to ensure the integrity and security of the Outdoors 365 Website and back-office applications.
Changes to Agreement
Outdoors 365 may, in its sole discretion, change this agreement or any part thereof at any time without notice. It is the Customer’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The Customer’s continued use of this Website following the posting of changes or updates will be considered notice of the Customer’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
Terms and Termination
This agreement shall commence when the user logs onto the Outdoors 365 Website and continues indefinitely until terminated by Outdoors 365 in terms of Security hereto or for any other reason.
All rights not expressly granted herein are reserved.
